General Terms and Conditions

I. Introductory Provisions

  1. The General Terms and Conditions govern the contractual relations and obligations arising from them between Cinemart plus, s.r.o., Národní 28, Prague 1, IČO 28371267, DIČ CZ28371267, registered in the register C 136814/MSPH at the Municipal Court in Prague. (hereinafter referred to as the “Operator”).

  2. The contractual relationship between the Operator and the customer – the buyer – arises by purchasing a ticket for a cultural performance operated by the Operator.

  3. The customer who purchases tickets directly at the Seller’s premises or via the Internet hereby expresses his agreement with these general terms and conditions, which are binding on both contracting parties.

  4. The version of the general terms and conditions valid on the day of payment of the purchase price for the ticket is decisive for the contractual relationship between the Seller and the customer.

II. Explanation of terms

The abbreviation "GTC" means these general terms and conditions.

A ticket means one or more tickets that the customer pays for at the Seller's box office.

An electronic ticket means one or more electronic tickets that the customer orders and pays for via the Internet/online.

The stated purchase price is the current price for the ordered performances, this price includes VAT at the statutory rate and is the final price.

III. Ticket Purchase

The customer can purchase a ticket directly at the Operator's premises, where they will receive a ticket upon payment at the Operator's cash desk, or via the Internet on the Seller's website: www.evald.cz.

When purchasing a ticket at the Operator's cash desk, the customer selects from the currently available tickets.

When purchasing a ticket via the Internet, the customer will receive an electronic ticket, which is equipped with a numeric barcode/QR code, and will be sent to the customer to the e-mail address specified and entered by the customer in PDF format for printing or will be sent to the customer to the e-mail address specified and entered by the customer for the possibility of saving it to a mobile phone, provided that the ticket is ordered and paid for via the Internet. The customer can pay the purchase price via the Internet with the following types of payment cards: MasterCard, Maestro, MasterCardElectronic, Visa, Visa Electron or via selected banks by online entry and transfer, or via Apple Pay, Google Pay.

Discounts on tickets can only be applied to brick-and-mortar sales. They apply to the categories of disabled/disabled, children, seniors for selected programs according to the Operator's current offer.

IV. Other conditions

Numerical barcodes/QR codes on electronic tickets can only be scanned once by a reading device, i.e. upon any further presentation of the numeric barcode in printed form or on a mobile phone, the repeatedly presented electronic ticket will not be taken into account and entry to the Operator's facility will not be permitted on their basis, regardless of whether the electronic ticket is presented.

The Operator is not responsible for any difficulties caused by unauthorized use or copying of an electronic ticket. Its forgery is punishable. An electronic ticket also becomes invalid if it does not contain the data necessary for its control or if it has been modified by additional modifications.

V. Withdrawal from the contract

For the reason stated in the provision of Section 1837, letter a j) of the Civil Code, the purchase of a ticket cannot be withdrawn by the procedure set out in Section 1829 of the Civil Code (withdrawal within 14 days without giving a reason), as in this case it is a contract for the use of free time and the performance (participation in the performance to which the ticket entitles) is provided on a specified date or time.

In the event that a performance for which the customer has already purchased a ticket or electronic ticket is cancelled, the customer will be refunded the purchase price under the following conditions:

• for a ticket purchased at the Operator's box office, the customer will be refunded the price paid if he/she arrives at the box office where he/she purchased the ticket without undue delay, or, if the customer is interested, the ticket can be exchanged for a ticket for another performance at the Operator's premises of the same value or a voucher of the same value will be issued,

• for an electronic ticket, the customer will be refunded the price paid after a written complaint has been made by bank transfer.

VI. Governing law, place of jurisdiction and out-of-court settlement of consumer disputes

Contractual relations between the Seller are governed by Czech law and the Czech courts are competent for any legal disputes.

The Seller's general court has local jurisdiction for resolving disputes between the Seller and the Customer, unless otherwise provided by law.

If a dispute arises between the Seller and the Customer and the dispute thus arising cannot be resolved amicably, the Customer is entitled to submit a proposal for resolving such a dispute to the entity for out-of-court resolution of consumer disputes, which is: Czech Trade Inspection, Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2, e-mail: adr@coi.cz, website: adr.coi.cz.
